Sentencing delayed for California dentist and wife who stole from patients

Dr. Edward and Mary Rose Bodek used others' credit cards

Former dentist Edward J. Bodek, 60, and his wife Mary Rose Bodek, 56, have twice delayed their sentencing, since they admitting stealing from patients.

Each defendant was charged with 45 felonies that alleged ID theft and fraudulent use of others’ credit cards. Twenty-two victims were named in a forty-page document filed by a prosecutor.

The Bodeks had a dental practice at 317 North El Camino Real in Encinitas, California, for more than twenty years. Mary Rose Bodek worked the front desk and was office manager and financial controller; there were no other employees. The couple had an apartment in nearby Carlsbad.

When confronted by investigators, “Dr. Bodek said he was sorry for doing this but he and his wife had been financially strapped and needed the money,” according to prosecutor Anna Winn.

Dr. Bodek was arrested on March 12, 2013. His wife Mary Rose was arrested two days later when she disembarked a plane at Lindbergh Field, having just arrived from the East Coast. (The Bodeks have a home in Maryland.) Investigators said they found more than 100 credit cards and store gift cards in Mrs. Bodek’s luggage.

Prosecutor Anna Winn claimed in court paperwork:

“Dr. Bodek gave agents keys to storage units rented by himself and his wife. Agents located 30 different storage units rented by the Bodeks. The storage units were full of women’s clothing, much of it bearing store price tags from stores such as Saks Fifth Avenue, Nordstrom, and Neiman Marcus. The storage units also contained high-end handbags on metal racks, also with store tags attached, and many fur coats were found in storage bags. These coats also had price tags for $5,000 or more attached and appeared to have been un-worn. Some of the clothes appeared to have been bought over 10 years ago.”

The Bodeks were held in lieu of $1.5 million bail, before they signed plea deals on June 25, 2013.

Each defendant admitted taking more than $65,000; investigators had claimed more than $260,000 in disputed charges.

The Bodeks admitted 3 felonies: elder financial abuse and two counts of stealing another’s credit card information to commit fraud. The remaining charges were dismissed.

“They are each going to get probation and 365 days in jail,” according to prosecutor Anna Winn.

Victims are expected to be in court for sentencing.

Sentencing was delayed again yesterday, August 16. The new time is 1:30 p.m. on Wednesday, August 21, 2013, in department 6 of San Diego’s North County Superior Courthouse.
