A 20-year-old man was charged this afternoon with pre-meditated attempted murder on 49-year-old Lisa Badgett and first degree murder on 47-year-old Robert Riggins.
The two victims were shot “at point blank range with a rifle” according to prosecutor David Bost, who spoke at Diego Martinez’ first court appearance in San Diego’s North County Superior Courthouse, today.
The two victims were reportedly in a truck when they were shot, across the street from the home of Diego Martinez, in the 4700 block of Calle Solimar, according to Oceanside Police.
It was just after midnight in the early morning minutes of Thursday, August 30 when police were called and found a woman in a truck screaming for help.
Police Lieutenant Leonard Mata said shooting victim Lisa Badgett sustained non-life threatening injuries and was transported to hospital for treatment.
The other person who was shot, Robert Riggins, is said to have staggered from the truck but succumbed to his fatal wounds in the driveway of a nearby home, in the 300 block of Calle Mariposa.
Oceanside police reported finding a rifle in Martinez’ home but could not confirm if it was the same weapon used in the shooting.
Judge Marshall Hockett declared Martinez “an extreme danger to the community” and set bail at $5 million.
Diego Martinez, 20, pleaded not guilty through his public defender, Emily Harmon, and is expected to appear next in court September 13.
