Christopher Bradley Nutt, 24, admitted sexual intercourse and possession of pornographic photos of a 12-year-old girl in a plea deal, and was sentenced to 270 days in local jail.
The plea deal was signed in August, he was sentenced yesterday in San Diego’s North County Superior Courthouse.
Nutt has been in a San Diego County jail since he was arrested last May and charged with six lewd acts with a child and using a child to create pornography and possession of child porn, ten felonies in all.
Escondido Police stated they found the 12-year-old girl in a bedroom with Nutt, the early morning hours of May 27, 2012. The girls parents had reported the child missing, and police investigated the girl’s cell phone use to locate her. Police stated that Nutt and the girl had met through “an online social network site.”
Christopher Nutt’s privately retained defense attorney, Dan Greene, commented: “There was no seducing. From the text messages it was clear that it was a mutual, consensual encounter. The victim registered on the ‘dating’ site as an adult. The site requires a new user to input a date of birth which must show the person is 18+. How she listed her age in her profile apparently will never be proven because the website company chooses not to maintain those records or that information.”
Defense attorney Greene stated that Nutt “was told and believed she was 18” but also “at one point she said she was 16.” The attorney said activity between his client and the girl was not “forceful” and “the acts were all voluntary.”
Christopher Nutt will have to register as a sex offender, and it will be “up to the probation department” to decide if he must wear a GPS monitor once he is released, according to attorneys.
