Encinitas Man Accused of July 4th Holdup -- of Neighbors

The night of the Fourth of July, just past midnight, police were called to the 800 block of Clark Avenue in Encinitas. The alleged victims who had dialed 911 told police that an Hispanic male demanded their belongings while “brandishing a rifle.” The victims said they were just getting out of their own vehicle when they were robbed, and then allowed to walk away, according to Police Sergeant Darrell Strohl.

Police responders said they found Hernan Cruz “a short distance away…in the yard.” They also found a loaded shotgun and a ski mask in the same yard with Hernan Cruz, according to Sgt. Strohl.

Hernan Cruz has listed the same street, the 800 block of Clark Avenue in Encinitas, as his home address in court paperwork, in past.

In March 2011, just a few days before his 19th birthday, Hernan Cruz was arrested for having a switchblade with the knife blade longer than two inches. He was also accused of being “under the influence of intoxicating liquor in such a condition that he was unable to exercise care for his own safety and the safety of others.” Cruz bailed out immediately, posting the $2,500 bond in time for birthday cake. The charges were ultimately dismissed because the only officer-witness had moved to Florida.

Hernan Cruz, now 20, is expected to be arraigned on new weapons and robbery charges in San Diego’s North County Superior Courthouse on Monday, July 9.
