Christopher Bradley Nutt, 24, admitted sexual intercourse and taking photographs of a 12-year-old girl in a plea deal he signed this past week.
Nutt has been in a San Diego County jail since he was arrested last May and charged with six lewd acts with a child and using a child to create pornography and possession of child porn, ten felonies in all.
It created an uproar in San Diego County when Escondido Police revealed they had arrested a man who was caught in his own apartment, in his bedroom, with a 12-year-old girl. The two reportedly met through an Internet dating service. Local police tracked down the young girl’s whereabouts the early morning hours of May 27, 2012, by investigating the girl’s cell phone usage. Her parents had reported her missing.
Christopher Nutt’s privately retained defense attorney, Dan Greene, said the young girl had misrepresented her age in an online social network, and that activity between the child and his client was not “forceful” and “the acts were all voluntary.” The defense attorney said the offense is what used to be called “statutory rape.”
In the felony plea deal, Christopher Nutt expects to get 270 days jail time, and he will have to register as a sex offender. Nutt could have gotten as many as 4 years in State prison plus one year in County prison, according to paperwork in his court file.
Attorneys said it will be probation officers who decide if Nutt will be required to wear a monitor. Nutt’s attorney has asked for a change of jurisdiction to Los Angeles County so the offender can “reside with his father.” Christopher Nutt is formerly from San Dimas, in Los Angeles County, and had only recently moved to Escondido at the time of the incident, according to his attorney.
The same judge who took the plea deal, Honorable Kimberlee Lagotta, will sentence Christopher Nutt on October 4, in San Diego’s North County Superior Courthouse.
