A man accused of violent gang activity in Escondido pled out to a reckless driving charge, in court yesterday.
Alexander Pedro Cueva, 21, faced a charge of assault with a deadly weapon for benefit of criminal street gang in May of this year. He was out on probation at the time of the alleged offense for an earlier violent felony, attempted robbery with personal use of a firearm, that case was decided in 2009.
Yesterday morning, August 28, the defendant admitted felony evade officer with reckless driving, and in exchange the assault charge and gang allegations were dismissed. A separate felony charge for burglary was also dismissed in the plea deal.
Alexander Pedro Cueva expects to get 32 months in custody, according to his defense attorney Rick Layon, and sentencing was set for September 27. The same judge who signed the plea deal, Honorable Daniel Goldstein, will pronounce sentence.
Deputy District Attorney Jon Oliphant negotiated the plea deal on behalf of the people of the State of California.
