Prosecutor: Repeat DUI Offender Killed Motorcyclist

Brian Joseph Webb II, 34, was charged with gross vehicular manslaughter in San Diego’s North County Superior Courthouse today.

Webb is accused of causing a fatal collision on the I-15 freeway in the Escondido area last Saturday, driving his truck south into the north-bound lanes and running into a man riding a motorcycle. Robin Vaughan was the man who “died at the scene,” according to the prosecutor and court paperwork.

Prosecutor Kelly Mok said defendant Webb was out on bail for a prior DUI matter when he drove the wrong way onto a major San Diego County freeway on July 28.

Just three weeks prior, the night of July 5, Brian Joseph Webb was stopped as he drove out of a parking lot -- in that instance his blood alcohol level tested at .30 percent, the prosecutor said. The legal BAL limit is usually considered to be something under .08 percent. Webb had a court date of August 16 for that matter.

On June 22 2012, the same defendant was arrested in Riverside County for DUI and “that case is still under review,” the prosecutor said.

Other DUI priors that the prosecutor listed for Webb include: one DUI in Hemet in year 2000, two more DUIs in San Diego County in 2004, and a DUI in Riverside County in 2007.

Judge Marshall Hockett said, “This is an absolute senseless tragedy, if anyone knew they shouldn’t be drinking and driving it is this defendant.” The judge declared Webb “an extreme danger to the community” and set bail at $5 million.

Webb’s next court date is August 21.
