Eduardo Durate, age 37, went to the residence of Ann Valdez, age 41. The two were “formally involved in a romantic relationship, and they have a child together,” states Lt. Kevin Rooney of SDPD Homicide. He was there to pick their child up.
An argument occurred that became physical. Durate apparently “forced” Valdez to her second story condo, according to the police report.
“Durate picked Valdez up and threw her over the railing,” says Rooney.
She suffered serious head trauma from the fall.
She was transported to the hospital where she was in critical condition. On April 16, at 7:30 p.m., she died.
Durate was in custody for the assault and attempted murder with a domestic violence enhancement, felony child abuse and making a criminal threat. He pleaded not guilty on April 15 and is being held on $1 million bail at the South Bay Courthouse, as ordered by Judge H. Ronald Domnitz.
Durate is now charged with homicide.
A readiness conference has been scheduked for April 22; a preliminary hearing for April 28.
