Interstate 8 at West Mission Bay Drive Incident on September 15, 6:30 p.m. – Hearing on December 17 California Highway Patrol
After a December 17 preliminary hearing in San Diego Superior Court, John Taskey of La Mesa, 46, who has been convicted of DUI five times in the past 10 years, will stand trial for second-degree murder in the death of 75-year-old Rosa Degerman. He is being charged with gross vehicular manslaughter while intoxicated.
On September 15, 2007, Taskey was on parole from his fifth DUI in 2006 and was driving while intoxicated. At 6:30 p.m., his Chevrolet pickup struck a car on Interstate 8 near the exits for Sunset Cliffs Boulevard and West Mission Bay Drive, according to the District Attorney’s Office.
Rosa Degerman was immediate killed when Taskey’s truck, going at freeway speed, slammed into the vehicle her son was driving.
Degerman’s son suffered a mild concussion, and her 11-year-old granddaughter suffered a fractured shoulder.
Taskey was driving with a 0.10 blood/alcohol level, which is 0.02 points higher than the legal limit.
To get a second-degree murder conviction, the district attorney will have to prove that Traskey exhibited “willful disregard” for life when he got behind the wheel of his truck intoxicated.
If convicted, Traskey can receive a sentence of 15 years to life in state prison. Currently, he remains in the George F. Bailey Detention Facility on $1 million bail.
