An officer with the Chula Vista Police Department drove into the south parking lot of the South Bay Courthouse where a fueling station is housed. While driving through the parking lot to get gas, he encountered a male subject lying on the asphalt. That officer was joined by another Officer who approached the male subject for questioning. The subject appeared coherent and was asked to leave the premises. The officers then proceeded to the fuel station.
The subject went back and laid down on the asphalt. Officers approached the subject again and told him he would have to comply with their order to leave, or be arrested. At this point the subject became combative and began physically fighting the officers. One officer was able to deploy his taser, striking the subject. There was minimal effect. The subject continued to physically fight the officers as they attempted to take him into custody.
A third officer arrived at the scene. The subject had knocked one officer to the ground and was fighting the second. That officer was able to deploy his firearm while ordering the subject to halt.
Despite verbal warnings the subject continued his attack.
The officer, believing his life and the lives of his fellow officers were in danger, fired his weapon. The subject continued attacking the second officer even after shots had been fired. The third officer, while ordering the subject to disengage, also fired at and struck the subject, halting the attack.
Paramedics were called and began lifesaving procedures. The subject died at the scene. Two of the officers were taken to a nearby hospital for treatment of injuries. The injuries are not considered serious.
The subject has not yet been identified.
An investigation into the incident is in process.
