Gunshots were heard and officers of the SDPD were advised that someone had been shot. They arrived and saw a male standing in the street, holding a handgun. He was identified as William Porter, 22. Porter was taken into custody without incident, according to Sgt. Dave Johnson.
Officers located an injured male in nearby condominium. This male, Larry Kermit King, 47, was suffering from serious injuries; one was a gunshot wound. Police and Fire personnel attempted first aide. The male victim was pronounced dead at the scene.
Investigation revealed that the victim had apparently been arguing with his ex-girlfriend inside the condo at the Archstone University Towne Centre Apartments, where she lives. She went to a neighbor's condo nearby and asked for help.
A male occupant of that condo, William Porter, and his wife, Nicole Porter, 22, both armed themselves. William Porter confronted King. There was a heated argument outside the condo. Several shots were fired. The victim was hit. Investigators believe that both husband and wife shot King, Nicole Porter firing from the balcony.
A restraining order had been issued against King by his ex-girlfriend on February 26, 2007, based on allegations of domestic violence.
William and Nicole Porter were both arrested for one count of murder.
The case has caught national attention by supporters of the right to bear arms and the right to self-defense. The San Diego District Attorney's Office has determined this was not a case of self-defense and filed charges. The Porters have pleaded not guilty. They are free on bail, pending a trial. William is charged with murder and Nicole is charged with assault with a deadly weapon.
A preliminary hearing is set for September 10, 2007.
