Phatak mentioned during the interview that scripting or teaching narrowly prescribed curriculum is happening in New York where common core was rolled out earlier. School officials Gandara and Sandoval plead guilty

My apologies for not filling in the details of the felony and conspiracy. The felony for both Sandoval and Gandara was Penal code section 182. Oskidoll is correct, conspiracy. The misdemeanor for both is govt code section 89503, essentially accepting gifts over the state limit.

I know that negotiations can continue during this last stage of state mediation--I believe I heard there is an April date??? Sweetwater teachers went out once before-it was a one day strike but I haven't found the year yet. Just curious if anyone knows.

Gloria and Goldsmith vindicated so far

Hey Dorian, great work and interesting to follow. While the San Jose case is out there, for now, there are two other things to consider. When I spoke with a Chula Vista city attorney in 2011 for a reader story on this question, he told me they counsel city officials to not conduct public business on private accounts. And certainly elected officials could choose not to. Cities, schools, public entities could also legislate against it though it would be more efficient at the state/federal level.

Quinones, Ricasa, Cartmill, Cabello weigh pleas vs. fighting

Regarding the posted Sweetwater meeting tomorrow evening, CalAware has shared this: CaliforniansAware, CalAware, is a non-profit organization whose mission is to defend open government. When asked to comment on the Sweetwater trustee situation, CalAware director Julie Biggs offered this: “Assuming there are no local rules to the contrary, California law sets a quorum as a quorum of the legislative body as a whole. (Government Code Section 36810) Even though there are currently vacancies, the legislative body is still comprised of five seats and the quorum is calculated on that number. Therefore, all three remaining members must be present in person or telephonically for any action to be taken. Adoption of ordinances, resolutions and orders for payment of money require a vote of the majority of the body as a whole (Government Code Section 36936), so if any of those matters are on the agenda, there must be a unanimous vote of the three members. Certain other actions such as urgency ordinances or eminent domain resolutions require a super majority vote. Obviously, those cannot be acted upon in the present circumstance. Other action may be taken by a majority of those present, i.e., two votes.”
