Problem is solved, and the $32+ million in Cash and Bond Proceeds in the Successor Agency Affordable Housing Master Plan would be available immediately to End Homelessness in San Diego, through the HUD-mandated Regional Continuum of Care Council (RCCC).

The Navy Broadway Complex (NBC) is owned by our Federal Government. The State Trust Tidelands surrounding NBC belong to the people of the State of California. The State made the City the Trustee, then the City made the Port Authority the Trustee. The NBC is within the Port Master Plan area for the North Embarcadero, and the planning and development issues are interrelated. The California Coastal Commission (CCC) is suing the Navy for lack of Seismic evidence to confirm or deny active faulting on the Navy Broadway Complex site, and all other outstanding issues like climate mitigation. Prior the CCC allowed the Port, City, Civic San Diego, CCDC, and the NEVP to ignore the issue of active faulting on State Tidelands. The CCC and the Port also claimed that rigid PVC pipes for new lifeline utilities in the Seismic Hazard Zones are flexible and can take deformation from earthquakes or settlement. No Clue. Except that the Office of the Mayor takes legal advice on Successor Agency assets from City Attorney Goldsmith and Civic San Diego. That is a great question for the new COS Ms. Burdick. Prior there was no follow through. No Clue why Mayor Filner's office has yet to ask, let alone receive, a legal opinion from Attorney General Kamala Harris on the outstanding issues. Everyone wants the Status Quo with the downtown crowd controlling the new source of short- and long-term Revenue including an annual $200 million in lease payments, parking revenue, argreements, contracts, etc. No elected official would look into the matter including Toni Atkins, Christine Kehoe, Nathan Fletcher, Carl DeMaio, Kevin Faulconer, Susan Davis, Todd Gloria, Donna Frye, etc. The issue is very complicated. However the hidden Reserve money should be unfrozen before any recall election. The issue also includes $225 million each for the Convention Center Phase II Expansion and Petco Park, $144 million in misappropriated HUD debt, $372 million in unmet Affordable Housing, and other City Loans.
