The potholes of Harbor Drive

That's some nice math work. One thing I should clarify, potholes were not the only issue here. According to the complaint and additional court docs, there were substantial gaps in the asphalt from where the railroad tracks, owned by BNSF, intersect the road. No larger than a 3 inch gap is allowed. Here, however, the gaps measure approximately 8 inches. Considering the alleged potholes, depressions, as well as the gaps at the tracks, it's more than a speeding biker vs pothole. We'll have to wait and see if the jury agrees. Thanks.-dH

JW: Thanks for the comment. I should have added the estimated speed as part of the story. According to the documents Powell was traveling at approximately 55 in a 40mph zone. Witnesses say he was stopped at a red light and took off when it turned green.-dH

Tased again and again in Vista parking lot

JW: Thanks for the comment, and apologies for the confusion. The dismissal arrived as a result of the settlement. I was only trying to establish a timeline by including the dismissal part. Torres agreed to a $3 million settlement. It is unclear when County supervisors approved the agreement, as they did not respond to my requests for additional info. I should say I contacted them on the Thursday before a holiday weekend, so maybe that was the reason. I assume they will respond this week with additional details. As for your other comment about digging deeper into this story, I agree. Many of my stories are meant to be quick news items, thus the story above. That said I will see what I can do when I get more information on the settlement. Thanks for reading and for the comment. I appreciate the feedback.-dH

Project is not dense enough or land is too steep

Hello Cassander: The lawsuit makes several claims the first of which is that the project does not meet minimum density requirements. The city/applicant, however, say the plan was initially approved in 2014 before any plan update. The second argument is the land is not suitable for this type of development due to the terrain. The city granted the applicant some easements which, according to the lawsuit, encroaches on sensitive habitats. The suit claims that the city should not have granted any exemptions because of the encroachments as well as the terrain. Hope that makes sense. Sorry it didn't the first time around.-dH

City reaches settlement in pedestrian death of 7-month-old girl

I submitted the PRA today for any mention of realignment proposals. We'll see what they come back with. There's also a possibility, albeit small, that this could be a condition of the settlement agreement. We will have to wait for that as well. I hope the attorneys for the family will discuss the agreement after council approves it tomorrow. Thanks for the comment.-dH

Cassander: Overall, I think the city does a good job in responding to the PRAs for the most part. Staff are helpful and accommodating. That said, when these lapses occur one has to wonder whether they happened on purpose. There have been several cases where I submitted PRAs and received a different response from those provided to others. One such instance was the chalk case, when the city gave me emails from BofA representatives seeking prosecution but failed to give those same emails to the attorney for Jeff Olson. While this case is much more than just a PRA issue, it definitely shows more can be done to improve transparency. Thx-dH

Just Wondering: Thanks for the update on the intersection. I am planning on submitting a PRA to see whether there are plans to realign the intersection. As for whether the city settled to avoid seeing Faulconer take the stand, I'm sure that was at least a small part of it. Other factors likely included that the attorneys had a case for PRA violations in addition to the fact that there were so many complaints made about the intersection. It's difficult to believe that a jury wouldn't be swayed by the complaints, the inaction by the city, and the police investigator's determination that visibility, and not reckless driving was the underlying factor. Of course, PR likely played a part as well. Thanks for the great comment and insight! -dH
