Ten-Year Prison Term for Oceanside Bar Fight
Bruce Erwin Hamil was sentenced to ten years in prison in the Vista courthouse on January 5 2012. As expected. Update posted by Eva Knott.

Alleged Oceanside Robbers Have a Day in Court
Both men pleaded guilty to robbery this month, on December 13, and will be formally sentenced in March. According to the plea deal paperwork, Nestor Vilchis, 21, expects to get 3 years in state prison and William Melgar, 23, expects to get 4 years. Allegations of the robbery being committed for gang benefit were dropped, although prosecutor Cal Logan asserted in papers filed with the court: “Melgar is a documented Center Street gang member and Vilchis is a member of the Mesa Locos criminal street gang.” Update by Eva Knott.

She didn't steal the Belgian Malinois in Escondido. She rescued It.
Trina was in court this morning, trying to get her 240 day jail sentence reduced. Prosecutor Paul Myers warned the court against “sheer manipulation” and argued against any reduction. Defense attorney William Mathews said that freeing Trina would allow her to go back to work and begin paying restitution to the dog owner. Mathews also said, “She has absolutely learned her lesson,” and that Trina would be willing to do volunteer work in lieu of jail. Judge Runston Maino wondered aloud, again, about where Elvis-the-dog is now, and hinted that if the dog could be found it might be influential. Judge Maino looked at Trina when he said, “I am going to deny your request.” Trina Vukov was taken back to Vista jail at the close of the hearing this morning, November 9, at 9:30 a.m. Reported by Eva Knott

The public defender who represents Trina told me that he has scheduled a court hearing before the same judge who heard the trial, to ask for “leniency.” Attorney William Mathews said he hopes to shorten Trina’s jail sentence this coming Wednesday, November 9. Trina and her attorney will be heard by Judge Runston Maino at 9 a.m., in department 26, fourth floor of the Vista courthouse. The public is allowed to attend, but please be advised that this is a very serious judge who hears very serious matters, and he will keep a proper decorum in his court. Eva Knott

The first time I went to see Trina, she began to cry because someone came to visit her in jail. Since then, at least three other people have visited Trina while in custody. She has lost weight. She said she is using a stationary bicycle they have there, and she does push ups and sit ups and leg lifts in her cell. I have sent her emails joking about the Vista Jail Spa Weight Loss Program. Today she said, “If I could do it all over again, you know what I would do? I would call the Humane Society.” I gave Trina the chance to react to some of the comments which people have posted online, following her story in the READER. She is thankful for supportive comments. She said will not appeal her conviction, on her attorney’s advice; she fears annoying the judge and perhaps getting an even longer jail sentence. Regarding comments that claim Trina must have been angry because Belloni withdrew his offer for her to stay at his place: “I was absolutely not angry at all.” She said, “I was pleased to get my deposit check and be on my way.” I read aloud some of the comments by a person who identified herself as vuk99 – and Trina confirmed that she did put a blanket over the head of Elvis-the-dog “to keep him calm” when she put him into her car. Then Trina Vukov looked sad and her eyes got red, and she said that she was going to phone her ex-husband, and that both her daughters live with their father now. Eva Knott.

Orange County Man Guilty of Murder in Oceanside DUI Crash
William Vincent Romero was sentenced to 16 years to Life in prison on November 2 2011, by Superior Court Judge K. Michael Kirkman, who had heard the jury trial.

Arraignment of Motorist Accused of Killing Bicyclist James Swarzman
LATE UPDATE: It took a superior court judge exactly three minutes to find Joseph Ricardo Fernandez guilty of felony hit-and-run causing death, at the end of a trial last summer. Judge K. Michael Kirkman heard testimony for two days, July 11 and 12, and both attorneys finished their final arguments by 2:17 p.m., and then the judge declared his verdict at 2:20. It was a bench trial, in which one judge heard evidence instead of a twelve-person jury. The accused, Fernandez, had been out on bail since the fatal collision April 10 2011, and he remained at liberty until sentencing September 12 2011. Paperwork in the court file indicates that Judge Kirkman sentenced 46-year-old Fernandez to prison for 2 years, although it is noted at the bottom of the court “minutes” on sentencing day: “defendant requests fire camp.”

Bonnie Dumanis Subpoenaed in Michael Pines Case
UPDATE. Michael Theodore Pines was ordered to show up for a mental competency examination, which is now set for October 14 at the forensic psychiatric clinic in San Diego's downtown detention facility. At a hearing September 20 in the Vista courthouse, Judge Maino warned Pines that a bench warrant would be issued if he failed to show up for the exam. This after prosecutor James Romo said that Pines has "failure-to-appears" in Orange and Ventura County courts, with outstanding warrants, and Romo urged the judge to remand Pines into custody without bail. Judge Maino reminded Romo of his jurisdictional limits, and declined to order Pines into custody at the Sept 20 hearing.

Ten-Year Prison Term for Oceanside Bar Fight
Bruce Erwin Hamil was sentenced to ten years in prison in the Vista courthouse on January 5 2012. As expected. Update posted by Eva Knott.— January 6, 2012 8:36 a.m.
Alleged Oceanside Robbers Have a Day in Court
Both men pleaded guilty to robbery this month, on December 13, and will be formally sentenced in March. According to the plea deal paperwork, Nestor Vilchis, 21, expects to get 3 years in state prison and William Melgar, 23, expects to get 4 years. Allegations of the robbery being committed for gang benefit were dropped, although prosecutor Cal Logan asserted in papers filed with the court: “Melgar is a documented Center Street gang member and Vilchis is a member of the Mesa Locos criminal street gang.” Update by Eva Knott.— December 17, 2011 11:10 a.m.

Trina was in court this morning, trying to get her 240 day jail sentence reduced. Prosecutor Paul Myers warned the court against “sheer manipulation” and argued against any reduction. Defense attorney William Mathews said that freeing Trina would allow her to go back to work and begin paying restitution to the dog owner. Mathews also said, “She has absolutely learned her lesson,” and that Trina would be willing to do volunteer work in lieu of jail. Judge Runston Maino wondered aloud, again, about where Elvis-the-dog is now, and hinted that if the dog could be found it might be influential. Judge Maino looked at Trina when he said, “I am going to deny your request.” Trina Vukov was taken back to Vista jail at the close of the hearing this morning, November 9, at 9:30 a.m. Reported by Eva Knott— November 9, 2011 10:57 a.m.

The public defender who represents Trina told me that he has scheduled a court hearing before the same judge who heard the trial, to ask for “leniency.” Attorney William Mathews said he hopes to shorten Trina’s jail sentence this coming Wednesday, November 9. Trina and her attorney will be heard by Judge Runston Maino at 9 a.m., in department 26, fourth floor of the Vista courthouse. The public is allowed to attend, but please be advised that this is a very serious judge who hears very serious matters, and he will keep a proper decorum in his court. The first time I went to see Trina, she began to cry because someone came to visit her in jail. Since then, at least three other people have visited Trina while in custody. She has lost weight. She said she is using a stationary bicycle they have there, and she does push ups and sit ups and leg lifts in her cell. I have sent her emails joking about the Vista Jail Spa Weight Loss Program. Today she said, “If I could do it all over again, you know what I would do? I would call the Humane Society.” I gave Trina the chance to react to some of the comments which people have posted online, following her story in the READER. She is thankful for supportive comments. She said will not appeal her conviction, on her attorney’s advice; she fears annoying the judge and perhaps getting an even longer jail sentence. Regarding comments that claim Trina must have been angry because Belloni withdrew his offer for her to stay at his place: “I was absolutely not angry at all.” She said, “I was pleased to get my deposit check and be on my way.” I read aloud some of the comments by a person who identified herself as vuk99 – and Trina confirmed that she did put a blanket over the head of Elvis-the-dog “to keep him calm” when she put him into her car. Then Trina Vukov looked sad and her eyes got red, and she said that she was going to phone her ex-husband, and that both her daughters live with their father now. Orange County Man Guilty of Murder in Oceanside DUI Crash
William Vincent Romero was sentenced to 16 years to Life in prison on November 2 2011, by Superior Court Judge K. Michael Kirkman, who had heard the jury trial.— November 2, 2011 11:21 a.m.
Arraignment of Motorist Accused of Killing Bicyclist James Swarzman
LATE UPDATE: It took a superior court judge exactly three minutes to find Joseph Ricardo Fernandez guilty of felony hit-and-run causing death, at the end of a trial last summer. Judge K. Michael Kirkman heard testimony for two days, July 11 and 12, and both attorneys finished their final arguments by 2:17 p.m., and then the judge declared his verdict at 2:20. It was a bench trial, in which one judge heard evidence instead of a twelve-person jury. The accused, Fernandez, had been out on bail since the fatal collision April 10 2011, and he remained at liberty until sentencing September 12 2011. Paperwork in the court file indicates that Judge Kirkman sentenced 46-year-old Fernandez to prison for 2 years, although it is noted at the bottom of the court “minutes” on sentencing day: “defendant requests fire camp.”— October 20, 2011 4:15 p.m.

Bonnie Dumanis Subpoenaed in Michael Pines Case
UPDATE. Michael Theodore Pines was ordered to show up for a mental competency examination, which is now set for October 14 at the forensic psychiatric clinic in San Diego's downtown detention facility. At a hearing September 20 in the Vista courthouse, Judge Maino warned Pines that a bench warrant would be issued if he failed to show up for the exam. This after prosecutor James Romo said that Pines has "failure-to-appears" in Orange and Ventura County courts, with outstanding warrants, and Romo urged the judge to remand Pines into custody without bail. Judge Maino reminded Romo of his jurisdictional limits, and declined to order Pines into custody at the Sept 20 hearing.— September 22, 2011 5:53 a.m.
