Nephew testifies for accused arsonist

Superior Court Judge William Dato declared a mistrial today, August 7, 2014. The jury had sent out a note late in the afternoon, declaring they were hopelessly deadlocked: 7 for guilty and 5 for not-guilty. Then the judge inquired of jurors, to determine if a unanimous decision might be possible, but the jury was dismissed at 5:17 p.m. Attorneys will meet in the same courtroom tomorrow afternoon to determine the next course of action. Defendant Alberto Serrato remains in custody, in lieu of $250,000 bail.

About one month after the case was suspended, in early August a judge declared Cynthia Cdebaca sufficiently competent to assist in her own defense. Bad son

Gregory Dale Foley, 56, took the witness box this morning in his own defense. Among other things, he told the jury that he put a large knife to his own throat during the violent incident last September. He also described getting shot with rubber bullets as "more painful than you can imagine." Sergio Ramirez was declared guilty of attempted murder by use of firearm, in benefit of criminal street gang. Prosecutor is now Tracy Prior, and presiding judge is William Dato, in San Diego's North County Superior Courthouse.
