Tony had no idea why he killed his friend in Oceanside
David Anthony Strouth talked with three different, court approved mental health experts. They all agreed he suffered from Post Traumatic Stress Disorder. Strouth survived two tours of duty in Iraq, but the transition back into civilian life was too hard. This photo is taken during one of Strouth's interviews by a psychiatrist, which was video'd. Jail records show that Strouth is still in local custody, jail, he has not been taken to State prison yet.

29 years in jail for failed attempt to kill O’side cop
Visduh, thank you. One does wonder how Roberto Flores will do in prison. He expresses such hatred for police officers, and was so disrespectful of Honorable judge Blaine Bowman throughout trial. And he was disrespectful to his own attorney, too. Don't know how the prison staff handle this sort of thing.

Dogs doused with acid in Oceanside
David Christopher Herbert, 36, is set to begin his trial on the day before Thanksgiving, on November 22, 2017. Herbert, who continues to be at liberty on one million dollars bail, is expected to be in department 5 of San Diego's North County courthouse in Vista, at 8:40 a.m. It is unclear if the justice system expects to be able to seat a jury over the Thanksgiving holiday, or if the parties will ask for a "bench trial" in which only the judge hears the evidence, or perhaps the parties will seek a plea deal on that date. The District Attorney's website states that public defender Stacie Patterson represents Herbert at this time.

Damning evidence dogs accused pet abuser
David Christopher Herbert, 36, is currently set to go on trial this week in San Diego's North County Superior Courthouse in Vista, California. He is currently at liberty on one million dollars bail, and is expected to appear in department 5 before judge Carlos Armour at 8:40 a.m. on Wednesday, November 22, the day before Thanksgiving. It is unknown if anyone in the court system expects to be able to seat a jury panel during the Thanksgiving holiday, or perhaps Herbert will settle on a plea deal, on that date. Herbert's current public defender is listed as Stacie Patterson, on the District Attorney's website.

Lovejoy and McDavid guilty of attempted murder
The private defense attorney retained for Diana Lovejoy stated that he expects an appeal will be filed on her behalf, after her sentencing date in December. Bradley Patton said that normal legal protocol would be for appeal paperwork to be filed within 60 days of Lovejoy’s sentencing; but Patton does not “do appellate work,” so that appeal would be handled by a different attorney. Patton further opined that it could take an appellate court more than a year to rule on appellate objections, these might include critique of judge’s rulings or juror behavior.

Middle-aged cops were alleged targets of rage
The jury declared Roberto Flores guilty on all counts, the morning of October 31, 2017. They also declared true the allegations that the attempted murder on peace officer was willful and premeditated. Because Flores had a "prison prior" and was out on felony bail at the time of the new offense, this will cause "enhancements" at his sentencing, now set for November 30 before the same judge who heard trial. Prosecutor Keith Watanabe said he expects Officer Brad Hunter and his wife will give victim impact statements to the court, before sentence is declared. Also today, another trial is starting for the same defendant, Roberto Flores. In this case, he is accused of Felon in Possession of Assault Rifle. Jury is being selected now.

Damning evidence dogs accused pet abuser
The court system is trying to get David Herbert to pay for his own attorney. Herbert has claimed that all his money was used up, to post one million dollars bail, in cash. In court this morning, Tuesday, October 24, judge Carlos Armour granted Herbert’s request to be represented by an attorney from the Public Defenders’ office, in order to move his case along speedily, as the defendant wants. But the judge also stated that, “The defendant will be responsible for attorneys’ fees after the case is over. The defendant will have to pay attorneys’ fees, because it looks like Mr. Herbert is able to do that.” David Herbert continues to be at liberty as he awaits trial, set for November 22, 2017.

Devil in details of Carlsbad divorce case
Today they say voir dire will be Monday, that is when attorneys begin to question prospective jurors. But sometimes courts call potential jurors into the courthouse in advance, to pre-screen, because this trial might last 3 or 4 weeks. So jurors could get called in Wednesday or Thursday or Friday, just for the pre-screening, to see who is available for that long, to sit on jury. Wednesday, October 18, the court will hear pre-trial motions from attorneys.

Tony had no idea why he killed his friend in Oceanside
David Anthony Strouth talked with three different, court approved mental health experts. They all agreed he suffered from Post Traumatic Stress Disorder. Strouth survived two tours of duty in Iraq, but the transition back into civilian life was too hard. This photo is taken during one of Strouth's interviews by a psychiatrist, which was video'd. Visduh, thank you. One does wonder how Roberto Flores will do in prison. He expresses such hatred for police officers, and was so disrespectful of Honorable judge Blaine Bowman throughout trial. Dogs doused with acid in Oceanside
David Christopher Herbert, 36, is set to begin his trial on the day before Thanksgiving, on November 22, 2017. Herbert, who continues to be at liberty on one million dollars bail, is expected to be in department 5 of San Diego's North County courthouse in Vista, at 8:40 a.m. It is unclear if the justice system expects to be able to seat a jury over the Thanksgiving holiday, or if the parties will ask for a "bench trial" in which only the judge hears the evidence, or perhaps the parties will seek a plea deal on that date. Damning evidence dogs accused pet abuser
David Christopher Herbert, 36, is currently set to go on trial this week in San Diego's North County Superior Courthouse in Vista, California. He is currently at liberty on one million dollars bail, and is expected to appear in department 5 before judge Carlos Armour at 8:40 a.m. on Wednesday, November 22, the day before Thanksgiving. It is unknown if anyone in the court system expects to be able to seat a jury panel during the Thanksgiving holiday, or perhaps Herbert will settle on a plea deal, on that date. Lovejoy and McDavid guilty of attempted murder
The private defense attorney retained for Diana Lovejoy stated that he expects an appeal will be filed on her behalf, after her sentencing date in December. Bradley Patton said that normal legal protocol would be for appeal paperwork to be filed within 60 days of Lovejoy’s sentencing; but Patton does not “do appellate work,” so that appeal would be handled by a different attorney. Middle-aged cops were alleged targets of rage
The jury declared Roberto Flores guilty on all counts, the morning of October 31, 2017. They also declared true the allegations that the attempted murder on peace officer was willful and premeditated. Because Flores had a "prison prior" and was out on felony bail at the time of the new offense, this will cause "enhancements" at his sentencing, now set for November 30 before the same judge who heard trial. Prosecutor Keith Watanabe said he expects Officer Brad Hunter and his wife will give victim impact statements to the court, before sentence is declared. Also today, another trial is starting for the same defendant, Roberto Flores. In this case, he is accused of Felon in Possession of Assault Rifle. But the statements Roberto Flores made to cell mates showing his loyalty to "the team" are already being revealed to jurors by the prosecutor. Defense said Flores' statements were false bravado. The court system is trying to get David Herbert to pay for his own attorney. Herbert has claimed that all his money was used up, to post one million dollars bail, in cash. In court this morning, Tuesday, October 24, judge Carlos Armour granted Herbert’s request to be represented by an attorney from the Public Defenders’ office, in order to move his case along speedily, as the defendant wants. But the judge also stated that, “The defendant will be responsible for attorneys’ fees after the case is over. Today they say voir dire will be Monday, that is when attorneys begin to question prospective jurors. But sometimes courts call potential jurors into the courthouse in advance, to pre-screen, because this trial might last 3 or 4 weeks. So jurors could get called in Wednesday or Thursday or Friday, just for the pre-screening, to see who is available for that long, to sit on jury.
