Shelley Malil will be paroled, and released from prison, "imminently,"according to a statement from San Diego County DA Summer Stephan, released today August 28, 2018. The California parole board granted Malil parole in January, but Governor Brown referred the matter back to a full Parole Board for review. At a rescission hearing today, at Chuckawalla Valley State Prison, the defendant’s victims appeared via video conference. The hearing lasted about three hours, and the San Diego DA’s Office made argument for rescinding parole. After 20 minutes of deliberation, the board declined to rescind Malil’s parole. The DA's statement included: "Mailil’s eligible parole date was August 14, 2018. The hearing result today makes him imminently eligible for parole."

Shelley Malil is due to be released on parole, "imminently," according to a statement by San Diego County District Attorney Summer Stephan. The California parole board first okayed his release in January, then Governor Brown sent the matter back to the board for review, and after a 3 hour hearing today, August 28, 2018, the parole board again decided to grant Malil parole. DA Stephan declared, "To approve this individual for release, given his violent attack, ignores the very real danger he poses to public safety.”

Judge Carlos Armour just told the jury he expects prosecution to finish her case this afternoon, Tuesday, August 28. Defendant David Herbert will begin presenting his case tomorrow morning, Wednesday. Herbert has said that he intends to testify from the witness box, in his own defense. Herbert is acting as his own attorney.

Julie Harper gets another chance
In a brief hearing Wednesday morning, August 22, 2018, the public defender’s office was assigned to represent Julie Harper. She was not re-sentenced today. Brian Dooley now represents Julie Harper, and the new defender asked for time to obtain transcripts of past proceedings and to become familiar with the case. Keith Watanabe remains as prosecutor. Julie Harper was produced from prison and was present. The next hearing in this matter is set for October 29, 2018, it will be a *status conference*, not a new sentencing, yet.

Accused of hurting dogs, $1 million bail
Because the defendant is acting as his own attorney, he is allowed to directly question potential jurors. This morning defendant Herbert asked if anyone in the jury pool had experience with certain breeds of dogs. One woman who responded remarked on the “personality” of a poodle she knew. This seemed to surprise Herbert, who then questioned her use of the word “personality” for an *animal*. Judge Carlos Armour asked the defendant if he knew the definition of the word “personality,” and defendant Herbert responded, “Maybe it’s just me, but the part of the world I was raised in, an animal does not have a soul or a personality, an animal is just an animal.” Later a different woman asked to be excused, particularly because Herbert stated that dogs do not have souls. Jury selection was finished before lunch today, Tuesday, August 21, 2018. Evidence will be presented about 2 p.m.

Three women told the judge they did *not* want to consider graphic photo evidence of animal abuse, and they were excused from the jury pool. When court adjourned for the day, Monday August 30, there were nine men and three women in the jury box -- but they are not confirmed as the final selection. Jury selection resumes tomorrow morning, Tuesday, in San Diego's North County Superior Courthouse in Vista, California.

Accused of hurting dogs, $1 million bail
In court before the Honorable judge Carlos Armour, defendant David Herbert confirmed that he intends to testify in his own defense, as his only witness, in the trial in which he is acting as his own attorney. Trial is expected to last 2 weeks. Jury selection began this afternoon, Monday, August 20, 2018. This morning Herbert objected to a media request, he said it would be too distracting if he is photographed during trial. Herbert claimed he is already recognized “around town” and that he is threatened; he said more photographs of him would only add to his troubles. Judge Armour has not decided yet if any news media will be allowed to photograph during trial. The judge did inform Herbert that “My wife and I are members of the San Diego Humane Society,” and that the judge and his wife have rescued 3 or 4 dogs over the years, and that the judge gives money to the Humane Society every year. Defendant Herbert replied, “It’s definitely concerning to me, and I really do not know what to say to that, I really don’t.” The judge declined to disqualify himself.

Accused of hurting dogs, $1 million bail
In February 2017, the next door neighbor came home and said she found a liquid on both her husky dogs, and the liquid seemed to have "burned" them. The veterinarian who treated the dogs, Dr. Lindsay Hackett, commented: "I have no idea what type of chemical may have caused this. It did cause a stinging sensation when we touched it and it seemed to be odorless, I've never seen anything like it." From the court file.

Trouble on Garfield Street
Ryan Henry Hanson, 42, made a plea deal and was sentenced this week, on August 8, 2018. Prosecutor Jennifer Reischl released a statement after the sentencing hearing. “Mr. Hanson was sentenced yesterday afternoon. He pled guilty to one felony count of PC245(a)(4). He was sentenced to 365 days custody, with release to a Residential Drug Treatment program after 270 days custody. He was placed on 3 years of formal felony probation with the standard terms and conditions of probation.”

Shelley Malil will be paroled, and released from prison, "imminently,"according to a statement from San Diego County DA Summer Stephan, released today August 28, 2018. The California parole board granted Malil parole in January, but Governor Brown referred the matter back to a full Parole Board for review. At a rescission hearing today, at Chuckawalla Valley State Prison, the defendant’s victims appeared via video conference. The hearing lasted about three hours, and the San Diego DA’s Office made argument for rescinding parole. After 20 minutes of deliberation, the board declined to rescind Malil’s parole. The DA's statement included: "Mailil’s eligible parole date was August 14, 2018. The hearing result today makes him imminently eligible for parole."— August 28, 2018 4:19 p.m.

Shelley Malil is due to be released on parole, "imminently," according to a statement by San Diego County District Attorney Summer Stephan. The California parole board first okayed his release in January, then Governor Brown sent the matter back to the board for review, and after a 3 hour hearing today, August 28, 2018, the parole board again decided to grant Malil parole. DA Stephan declared, "To approve this individual for release, given his violent attack, ignores the very real danger he poses to public safety.”— August 28, 2018 4:08 p.m.

Judge Carlos Armour just told the jury he expects prosecution to finish her case this afternoon, Tuesday, August 28. Defendant David Herbert will begin presenting his case tomorrow morning, Wednesday. Herbert has said that he intends to testify from the witness box, in his own defense. Herbert is acting as his own attorney.— August 28, 2018 1:49 p.m.
Julie Harper gets another chance
In a brief hearing Wednesday morning, August 22, 2018, the public defender’s office was assigned to represent Julie Harper. She was not re-sentenced today. Brian Dooley now represents Julie Harper, and the new defender asked for time to obtain transcripts of past proceedings and to become familiar with the case. Keith Watanabe remains as prosecutor. Julie Harper was produced from prison and was present. Accused of hurting dogs, $1 million bail
Because the defendant is acting as his own attorney, he is allowed to directly question potential jurors. This morning defendant Herbert asked if anyone in the jury pool had experience with certain breeds of dogs. One woman who responded remarked on the “personality” of a poodle she knew. This seemed to surprise Herbert, who then questioned her use of the word “personality” for an *animal*. Judge Carlos Armour asked the defendant if he knew the definition of the word “personality,” and defendant Herbert responded, “Maybe it’s just me, but the part of the world I was raised in, an animal does not have a soul or a personality, an animal is just an animal.” Later a different woman asked to be excused, particularly because Herbert stated that dogs do not have souls. Jury selection was finished before lunch today, Tuesday, August 21, 2018. Evidence will be presented about 2 p.m.— August 21, 2018 1:48 p.m.

Three women told the judge they did *not* want to consider graphic photo evidence of animal abuse, and they were excused from the jury pool. When court adjourned for the day, Monday August 30, there were nine men and three women in the jury box -- but they are not confirmed as the final selection. In court before the Honorable judge Carlos Armour, defendant David Herbert confirmed that he intends to testify in his own defense, as his only witness, in the trial in which he is acting as his own attorney. Trial is expected to last 2 weeks. Jury selection began this afternoon, Monday, August 20, 2018. This morning Herbert objected to a media request, he said it would be too distracting if he is photographed during trial. Herbert claimed he is already recognized “around town” and that he is threatened; he said more photographs of him would only add to his troubles. Judge Armour has not decided yet if any news media will be allowed to photograph during trial. The judge did inform Herbert that “My wife and I are members of the San Diego Humane Society,” and that the judge and his wife have rescued 3 or 4 dogs over the years, and that the judge gives money to the Humane Society every year. In February 2017, the next door neighbor came home and said she found a liquid on both her husky dogs, and the liquid seemed to have "burned" them. The veterinarian who treated the dogs, Dr. Lindsay Hackett, commented: "I have no idea what type of chemical may have caused this. It did cause a stinging sensation when we touched it and it seemed to be odorless, I've never seen anything like it." From the court file.— August 10, 2018 3:22 p.m.
Trouble on Garfield Street
Ryan Henry Hanson, 42, made a plea deal and was sentenced this week, on August 8, 2018. Prosecutor Jennifer Reischl released a statement after the sentencing hearing. “Mr. Hanson was sentenced yesterday afternoon. He pled guilty to one felony count of PC245(a)(4). He was sentenced to 365 days custody, with release to a Residential Drug Treatment program after 270 days custody.
