Thugs shot by would-be victim make plea deals
The District Attorney's office released this statement in December 2019, praising Deputy DA Christine Bannon: "In March 2019, the California Legislature signed into law Senate Bill 1437, changing the definition of malice as used in the law of murder. DDA Bannon has been the lead attorney for all SB1437 litigation in the San Diego District Attorney’s Office and manages petitions related to the bill. DDA Bannon has also trained DDAs on how to handle SB1437 petitions. Other counties have successfully argued to their courts that this law is unconstitutional based on DDA Bannon’s work. DDA Bannon excels as both a formidable trial lawyer and appellate litigator. Her contributions to both the San Diego DA’s Office and prosecutor’s statewide are worthy of the highest recognition."

David Anthony Strouth, now 38, was sent to San Quentin State Prison on Feb 5, 2018. This prison overlooks San Francisco Bay, and is about 20 miles North of downtown San Francisco. The California State Prison website states that he will be eligible for parole in eight years, in August of 2027.

You might not want a neighbor like Oceanside's David Herbert
Convicted dog abuser and scary neighbor David Herbert was sent to California State Prison on September 11, 2019. He is now 38 years old, and he will be eligible for parole in three years, in December of 2022. The State Prison website shows that he is held at the Sierra Conservation Center in Jamestown, California. That is about 100 miles due East of San Francisco, near the border of Yosemite National Park.

A fateful ride with Kellen Winslow, Jr.
Kellen Winslow Jr., 36, made a plea deal on the day the jury was set to hear opening statements from attorneys in his second rape trial, on Monday, November 4, 2019.Prosecutor Dan Owens said that Winslow Jr. avoided a possible life-in-prison sentence, and would now face from 12 to 18 years in prison. The defendant was facing 9 years in prison after convictions in his first trial, the prosecutor said. In the plea deal, Winslow Jr. admitted having sexual intercourse with Jane Doe 4 in 2003, when she was 17 and he was 19, and that victim was a minor who was unconscious during the act.The defendant also admitted “sexual battery” on Jane Doe 1, the 54-year-old hitchhiker who testified (during the first trial) that she was raped in the defendant’s vehicle. In exchange for the guilty plea to two counts, the remaining counts were dismissed. At the conclusion of his first trial last June, the jury found Winslow Jr. guilty of one felony rape and two misdemeanor lewd acts, those crimes against three different Jane Does. The first jury could not come to unanimous conclusion for 8 other counts. Some of those charges were set to be heard again by a new jury, this week in San Diego County Superior court. But the new jury of 6 men and 6 women never heard any evidence. Honorable judge Blaine Bowman carefully read all parts of the plea deal form to the defendant, to confirm his agreement. The defendant made long pauses, and often looked to his father Kellen Winslow Senior, seated behind him in the front row of the courtroom gallery. And Winslow Jr. often asked for parts of the plea deal to be read again to him, and then he hesitated before he responded. Especially there was a long wait when the defendant was asked if he waived his right to a jury trial. “We are ready to give you a jury trial, right now,” the judge said. Kellen Winslow Jr. then had a long discussion with his two lead attorneys, Marc Carlos and Gretchen Von Helms. The judge repeatedly told the defendant that he did not have to waive any of his rights, and they could proceed immediately with the trial, and that the jury was waiting outside in the hallway.The judge revealed that, “We started these (plea deal) discussions this morning.” And that he gave the defendant two hours over the lunch break to confer with his attorneys and both his parents, before the plea deal agreement was confirmed on the record Monday afternoon. As part of the plea deal, the defendant agreed not to challenge nor appeal his convictions from his first rape trial. Jury selection for the second trial began two weeks ago, on October 21, starting with a pool of 172 potential jurors.

You might not want a neighbor like Oceanside's David Herbert
The restitution hearing for David Herbert continues to be delayed. His victims have their own attorneys and are trying to attach that $1 million cash that Herbert posted for his bail, and is still being held on judge Armour's order. The next hearing for Herbert, currently held in local custody, is now set for this Friday, July 26, at 1:30 pm before Honorable judge Carlos Armour in the Vista courthouse.

Thugs shot by would-be victim make plea deals
The District Attorney's office released this statement in December 2019, praising Deputy DA Christine Bannon: "In March 2019, the California Legislature signed into law Senate Bill 1437, changing the definition of malice as used in the law of murder. DDA Bannon has been the lead attorney for all SB1437 litigation in the San Diego District Attorney’s Office and manages petitions related to the bill. DDA Bannon has also trained DDAs on how to handle SB1437 petitions. Other counties have successfully argued to their courts that this law is unconstitutional based on DDA Bannon’s work. DDA Bannon excels as both a formidable trial lawyer and appellate litigator. David Anthony Strouth, now 38, was sent to San Quentin State Prison on Feb 5, 2018. This prison overlooks San Francisco Bay, and is about 20 miles North of downtown San Francisco. Convicted dog abuser and scary neighbor David Herbert was sent to California State Prison on September 11, 2019. He is now 38 years old, and he will be eligible for parole in three years, in December of 2022. The State Prison website shows that he is held at the Sierra Conservation Center in Jamestown, California. A fateful ride with Kellen Winslow, Jr.
Kellen Winslow Jr., 36, made a plea deal on the day the jury was set to hear opening statements from attorneys in his second rape trial, on Monday, November 4, 2019.Prosecutor Dan Owens said that Winslow Jr. avoided a possible life-in-prison sentence, and would now face from 12 to 18 years in prison. The defendant was facing 9 years in prison after convictions in his first trial, the prosecutor said. In the plea deal, Winslow Jr. admitted having sexual intercourse with Jane Doe 4 in 2003, when she was 17 and he was 19, and that victim was a minor who was unconscious during the act.The defendant also admitted “sexual battery” on Jane Doe 1, the 54-year-old hitchhiker who testified (during the first trial) that she was raped in the defendant’s vehicle. In exchange for the guilty plea to two counts, the remaining counts were dismissed. At the conclusion of his first trial last June, the jury found Winslow Jr. guilty of one felony rape and two misdemeanor lewd acts, those crimes against three different Jane Does. The first jury could not come to unanimous conclusion for 8 other counts. Some of those charges were set to be heard again by a new jury, this week in San Diego County Superior court. But the new jury of 6 men and 6 women never heard any evidence. Honorable judge Blaine Bowman carefully read all parts of the plea deal form to the defendant, to confirm his agreement. The defendant made long pauses, and often looked to his father Kellen Winslow Senior, seated behind him in the front row of the courtroom gallery. And Winslow Jr. often asked for parts of the plea deal to be read again to him, and then he hesitated before he responded. Especially there was a long wait when the defendant was asked if he waived his right to a jury trial. “We are ready to give you a jury trial, right now,” the judge said. Kellen Winslow Jr. then had a long discussion with his two lead attorneys, Marc Carlos and Gretchen Von Helms. The judge repeatedly told the defendant that he did not have to waive any of his rights, and they could proceed immediately with the trial, and that the jury was waiting outside in the hallway.The judge revealed that, “We started these (plea deal) discussions this morning.” And that he gave the defendant two hours over the lunch break to confer with his attorneys and both his parents, before the plea deal agreement was confirmed on the record Monday afternoon. As part of the plea deal, the defendant agreed not to challenge nor appeal his convictions from his first rape trial. The restitution hearing for David Herbert continues to be delayed. His victims have their own attorneys and are trying to attach that $1 million cash that Herbert posted for his bail, and is still being held on judge Armour's order.
