Weldon McDavid shot Greg Mulvihill on secluded dirt path in Carlsbad
Today, July 28, 2020, an appeals court has ordered that Weldon McDavid will get another chance at sentencing, with the original trial court judge in San Diego County. The trial judge, Honorable Sim von Kalinowski, will now have the option of "striking" or ignoring the enhanced sentencing for personal use of firearm causing serious bodily injury. Both McDavid and Lovejoy have been appealing their attempted murder convictions on various technical points, but the appellate court upheld their jury convictions. One of the judges, of the three judge panel, particularly noted the "overwhelming" evidence of Lovejoy's guilt.

Thor slain in Carlsbad
Jay Alexander Terry made a plea deal, admitting voluntary manslaughter, and agreeing to 5 years in prison. He was sentenced on June 25, 2020, but remains in local custody because the San Diego County Sheriff is not moving around inmates during the virus scare.

Shootout in Pauma Valley
On the day of his sentencing, June 10, Jose Luis Nieto read a prepared statement to the judge. He faced up to 45 years in prison. Nieto told the judge, “All the elements were against me.” And, “The only ones present, was involved, was a minority male that was myself, with no other significant witnesses, making it the always controversial he said - she said circumstance.” And he said, “It was a huge misunderstanding.” Nieto told the judge that on the day of the shooting, “I voluntarily medicated myself with medical cannabis. The cannabis had an adverse reaction to my body and my mind, with devastating and severe consequences.” Nieto read to the judge, “I had no intentions to harm anyone, or commit any act of violence. Look at my clear record and background.” Nieto expressed regret at losing his nursing career. He finished by begging, “It is in your power, your honor, give me a second chance. I will not let you down, your honor.” Prosecutor Chandelle Konstanzer told the judge she spoke to the deputies who survived the shootout and “They all felt completely ambushed by Mr. Nieto. They were responding to a 911 call from him, asking for help.” Deputies also reported that they saw defendant Nieto “smirking” during his trial. One deputy said he feared that a minimal sentence for Nieto would set a precedent that it is “okay” to attack or kill law enforcement. After he listened to Nieto's prepared statement, Honorable judge Harry Elias said it was fortunate that “his aim was no good.” He noted that Nieto had fired at least five shots. Judge Elias reviewed the guilty verdicts and “stayed” many years of punishment for use of firearm, however those years will be enforced upon Nieto if he eventually violates parole, the judge said. The judge announced 29-year-old Nieto’s sentence as 31 years plus 8 months. Nieto is not expected to be transported to State prison immediately, because the San Diego County Sheriff is not moving anyone due to the virus scare. Nieto has 620 days “custody credit” so far.

An assault near The Jungle in San Marcos
Saul Rios Guzman, 38, had benefit of a Spanish speaking interpreter (by phone) during his video-court hearings. Guzman is held in lieu of $70,000 bail and is described in jail records as 5 feet 5 inches tall and 165 pounds. Guzman is next due in court July 13 to confirm a trial date in August 2020. Based on statements by two different prosecutors, the alleged victim, his former girlfriend, is afraid and reluctant to co-operate with authorities.

Parolee runs over motorcycle cop in Oceanside
An appeals court has granted Roberto Flores a new trial. In preparing for his new trial, Flores was allowed to act as his own attorney. But according to prosecutor Keith Watanabe, who will also prosecute the next trial, "Roberto Flores’ Pro Per status was revoked because he was being disruptive on video and talking over the judge." Public defender John Wilschke will again represent Flores, in his next trial. According to the prosecutor, when Flores was brought before a judge using the new tele-conference-video system, "He did not consent to the video hearing, leaving the judge with no choice but to confirm his jury trial as planned for September 28." So that is the current, expected date for his new trial.

Honorable judge Harry Elias ordered that the face of defendant Isaac Guerrero not be photographed. The courthouses have been closed because of the virus scare, and the jury trial for Guerrero is currently scheduled for April 27, 2020, although this date is likely to be delayed.

Shootout in Pauma Valley
When deputies first saw him, the shooter inside the house was shirtless. Hours later, when the special enforcement team extracted him from the house, suspect Nieto had dressed his own wound. A year later, the jury was shown photos of bloody pants which were removed from patient Nieto at hospital.

Weldon McDavid shot Greg Mulvihill on secluded dirt path in Carlsbad
Today, July 28, 2020, an appeals court has ordered that Weldon McDavid will get another chance at sentencing, with the original trial court judge in San Diego County. The trial judge, Honorable Sim von Kalinowski, will now have the option of "striking" or ignoring the enhanced sentencing for personal use of firearm causing serious bodily injury. Both McDavid and Lovejoy have been appealing their attempted murder convictions on various technical points, but the appellate court upheld their jury convictions. Jay Alexander Terry made a plea deal, admitting voluntary manslaughter, and agreeing to 5 years in prison. On the day of his sentencing, June 10, Jose Luis Nieto read a prepared statement to the judge. He faced up to 45 years in prison. Nieto told the judge, “All the elements were against me.” And, “The only ones present, was involved, was a minority male that was myself, with no other significant witnesses, making it the always controversial he said - she said circumstance.” And he said, “It was a huge misunderstanding.” Nieto told the judge that on the day of the shooting, “I voluntarily medicated myself with medical cannabis. The cannabis had an adverse reaction to my body and my mind, with devastating and severe consequences.” Nieto read to the judge, “I had no intentions to harm anyone, or commit any act of violence. Look at my clear record and background.” Nieto expressed regret at losing his nursing career. He finished by begging, “It is in your power, your honor, give me a second chance. I will not let you down, your honor.” Prosecutor Chandelle Konstanzer told the judge she spoke to the deputies who survived the shootout and “They all felt completely ambushed by Mr. Nieto. They were responding to a 911 call from him, asking for help.” Deputies also reported that they saw defendant Nieto “smirking” during his trial. One deputy said he feared that a minimal sentence for Nieto would set a precedent that it is “okay” to attack or kill law enforcement. After he listened to Nieto's prepared statement, Honorable judge Harry Elias said it was fortunate that “his aim was no good.” He noted that Nieto had fired at least five shots. Judge Elias reviewed the guilty verdicts and “stayed” many years of punishment for use of firearm, however those years will be enforced upon Nieto if he eventually violates parole, the judge said. The judge announced 29-year-old Nieto’s sentence as 31 years plus 8 months. Nieto is not expected to be transported to State prison immediately, because the San Diego County Sheriff is not moving anyone due to the virus scare. Nieto has 620 days “custody credit” so far.— June 22, 2020 6:49 p.m.
An assault near The Jungle in San Marcos
Saul Rios Guzman, 38, had benefit of a Spanish speaking interpreter (by phone) during his video-court hearings. Guzman is held in lieu of $70,000 bail and is described in jail records as 5 feet 5 inches tall and 165 pounds. Guzman is next due in court July 13 to confirm a trial date in August 2020. Based on statements by two different prosecutors, the alleged victim, his former girlfriend, is afraid and reluctant to co-operate with authorities.— June 22, 2020 1:21 p.m.
Parolee runs over motorcycle cop in Oceanside
An appeals court has granted Roberto Flores a new trial. In preparing for his new trial, Flores was allowed to act as his own attorney. But according to prosecutor Keith Watanabe, who will also prosecute the next trial, "Roberto Flores’ Pro Per status was revoked because he was being disruptive on video and talking over the judge." Public defender John Wilschke will again represent Flores, in his next trial. According to the prosecutor, when Flores was brought before a judge using the new tele-conference-video system, "He did not consent to the video hearing, leaving the judge with no choice but to confirm his jury trial as planned for September 28." So that is the current, expected date for his new trial.— June 5, 2020 11:57 a.m.

Honorable judge Harry Elias ordered that the face of defendant Isaac Guerrero not be photographed. The courthouses have been closed because of the virus scare, and the jury trial for Guerrero is currently scheduled for April 27, 2020, although this date is likely to be delayed.— April 7, 2020 6:39 a.m.

When deputies first saw him, the shooter inside the house was shirtless. Hours later, when the special enforcement team extracted him from the house, suspect Nieto had dressed his own wound.
