UCAN to Undergo Court-Supervised Reorganization
It makes a lot of sense to dissolve UCAN and start a new public interest organization to fight SDG&E. As the driving force behind UCAN, Shames will take all the donors with him to the new organization. If the employees sue UCAN and win, donations would dry up as donors would not want to pay judgements. It does not appear at this point that UCAN is viable, given the likelihood of ruinous awsuits. Shames' liquidation plan puts the kibosh on potential lawsuits and allows him to operate under the umbrella of a new organization. The plan seems to be legal. This scenario falls apart if Shames is indicted by the Grand Jury for moral turpitude. I believe that he's done nothing wrong, and will be shocked if it turns out otherwise.— February 28, 2012 10:54 p.m.
Ex Carlsbad Attorney Patricia Gregory to Serve One Year in Jail
Assuming Gregory starts collecting early social security benefits at age 62, I estimate her monthly income at between $3,000 and $4,000 per month. My understanding is that Gregory divorced a military officer, and receives a share of his pension. Her share of her ex-husband's pension is probably at least $2,000 per month. Most retired officers receive pensions in the range of $6,000 to $8,000 per month, depending on rank and years of service. By act of Congress social security benefits and military pensions have been placed beyond the reach of creditors. Social security and military pensions cannot be levied, liened, garnished, or attached. Gregory will serve her stint in jail and upon release will rent a nice apartment and have enough income to live in comfort. Tourism Picking Up, But More Slowly in SD
Hotel occupancy is low becasue the Convention Center isn't large enough to attract major conventions. When the Convention Center expansion is finished, then Convention Center bookings will be anemic because there aren't enough upscale hotel rooms. Equilibrium will never be reached. If the accusations against Burns are true, and his failure to respond to the complaint appears to be an admission of guilt, then this is truly a miscarriage of justice. If Burns did commit these offenses, then he should have been charged with felonies. The SEC accused him of stealing millions. He has probably hidden his money and will not pay a cent to the SEC. Controversial Bridgepoint, Sunroad End Lease
The chances of Jerry Sanders finding a private sector job after he finishes his term as mayor appear to be very slight. Jerry hasan't done anything for anyone. He looked aside while the FAA bent Aaron face down on the table and had its way with him. Sanders retirement office was on the 12th floor of the Centrum, and when the ironworkers removed the 12 floor, his employment prospects went with it. He couldn't get the Chargers Stadium or the Convention Center expansion underway. He's building the library, but there's nothing in the till to pay for it. He has not privatized anything to speak of. If Sanders destroys the Cabrillo bridge and guts the center of Balboa Park for Mark Erwin, there might be an office with a window view for him at Qualcomm. He could be director of security. He could cruise Qualcomm parking lots in an electric golf cart looking for engineers sleeping in their cars on company time.— February 21, 2012 10:35 p.m.
Michael T. Pines Files Another Suit
Under federal and state laws when a lender knowingly makes a loan that a borrower has no ability to repay, the loan is treated as a gift. Such loans are unenforceable in court. In order to obtain clear title to property a borrower in default should only have to prove that (1) s(he) filed an honest loan application, and (2) a prudent lender should have known that the borrower lacked the financial wherewithal to make the payments. If borrowers in default establish that mortgages are actually gift loans, then Judges should void mortgages and transfer clear title to borrowers. I think Pines was angered that Judges were illegally ordering foreclosures on houses that were financed with gift loans, and it drove him over the edge because he couldn‘t stop it.— February 17, 2012 10:53 p.m.
