I bet the problem Javier Rodriguez has is that the only cost he can control is his wage and benefit costs and thus is opposed to his employees having a contract with him. All businesses operate on contracts for goods and services except labor. It amazes me that we all deal in contracts from renting to buying a car to everything we buy with a credit card but we trust our employer to "do right" by us and not requiring him to have a contract.— March 2, 2020 7:43 a.m.

Most shopping center and strip mall leases are triple net. Large malls have triple net plus percentage. When landlords maximize their rents they are the first to lose tenants when the economy cycles south. Most small businesses operate on a thin profit margin and it does not take much of an economic disruption, think Corona virus, to put them out of business. My dad was a landlord. When there was a glut of space on the market his properties were full. When there was a lack of available space none of his tenants moved. I asked him why he had long time tenants and no space available. He told me that he kept his rents slightly below market and worked with his tenants in the bad times and did not take advantage of them in the good times. He had few problems and only one eviction in over 40 years. He made a lot of money and his tenants did too. When he was 80 he sold off his properties.— February 27, 2020 7:35 a.m.

The use of “independent contractors” has been used and abused by employers to pay low wages and no benefits. The tax code does define an independent contractor and, from what I can tell, it does not apply to true independent contractors. There have always been those who are independent of the employer/employee relationship. All independent contractor relationships have rules that must be followed. Years ago I was an independent owner-operator in the trucking industry. I owned my own tractor (truck). I was responsible for the fuel, maintenance and insurance on my truck. I contracted to various companies to pull their trailers and pick up/deliver their loads. Often I worked through a broker that found loads for me. I was independent and could choose which loads I wanted. Of course if I was too picky the companies and brokers would call someone else. I had to follow the instructions of the company or broker. I had to pick up the load at a specific place and time and deliver it at specific place and time. I was independent just like a small business owner is independent but like a small business owner, if you are not available to those who want your services then you will be out of business. Uber/Lyft drivers are independent contractors. They can choose when they work, what times they work, etc. Like an owner-operator an Uber/Lyft driver is responsible for their vehicle maintenance, fuel, insurance, etc. The tax laws are clear and should be enforced against those employers who misuse independent contractors.— February 22, 2020 8:12 a.m.
