In 2008, Californians voted to approve Proposition 8, which amended the state constitution to read, “Only a marriage between a man and a woman is valid or recognized in California.” This year, Californians will be voting on Proposition 3, which would remove that language and affirm the right to marry as both protected and fundamental, whomever or whatever it is a person wants to marry. Perhaps surprisingly, some conservatives are eager to vote for the proposition’s passage. “Look,” says Gunther Hateful, a longtime anti-gay activist who helped rally straights as part of the Bash the ‘Stache movement in 2008, “everybody knows that it was the passage of Prop 8, and the subsequent legal actions taken against it, that led to the United States Supreme Court overturning the express will of the people of the most liberal state in the country and paving the way for gay marriage nationwide. We amended the Constitution, and it was eventually declared unconstitutional. And looky here, now you’ve got a bunch of angry activists out to amend the Constitution, and passing a statewide measure to do so. Gosh, I wonder what happens next? And with a Trump-heavy Supreme Court to boot? Yes, by all means, amend away! I mean, it’s settled law! And it’s not like they overturned Roe vs. Wade!”
