In federal court, judge Gonzalo Curiel this morning (October 20) thumbed down a motion by Donald Trump's lawyers to throw out the Trump University case.
Former students at Trump's highly-touted real estate seminars had raised a question about whether Trump had "knowingly participated in a scheme to defraud," according to the New York Times.
However, a videotape of a Trump deposition remains under wraps, wrote Curiel, who said that a transcript offers a "substantially accurate" representation of the proceedings. Curiel is concerned that the videos could taint jurors, according to The Atlantic.
Curiel also would not throw out allegations that Trump was a participant in a civil racketeering scheme through Trump University.
In his presidential campaign, Trump claimed that Curiel was a Mexican and that could taint a case against him. Curiel was actually born in Indiana.
