On November 10, San Diego–based Dr. Seuss Enterprises filed suit in federal court, claiming a Connecticut company infringed on trademarks and copyrights of characters created by the late La Jollan Theodor S. Geisel, the children's author responsible for the works of Dr. Seuss.
ComicMix LLC "unabashedly misappropriates works belonging to [Dr. Seuss Enterprises, L.P.] intellectual property to create the look and feel of an authorized Dr. Seuss work," says the suit.
The Connecticut company published a work, Oh, the Places You'll Go!!" — the name of a Seuss book. The book uses the stylized font used in Seuss books and the unique Seuss illustration style. The lawsuit shows a number of cases in which the Connecticut company has illustrations in which the characters and backgrounds are almost identical to Seuss characters and locations.
The suit charges copyright and trademark infringement and unfair competition.
